Question:
I took my forklift in for repair and was given a verbal estimate of $1,000. I then received a bill for $2900.00. No written estimate. Isn’t the repair shop supposed to give me a written cost? Is it legal to verbally quote one price then send a bill for 2x the amount?
Nowland:
Repair shops are regulated by the Department of Consumer Affairs and certain language is required on the written estimate of costs. Also, there is a requirement that the estimate be a firm estimate. There may be an issue if the repair shop is commercial, meaning it is not a consumer service. In that case, it may not be regulated by Consumer Affairs. Alternatively, you may have a breach of contract claim for damages in the amount over the estimate. You can take the repair shop to small claims court and make a claim for the amount over and above the quote.
As always, consult with an experienced litigation attorney before taking any action related to the legal issues discussed above.
