This case involves multiple employees of a small restaurant chain in the Los Angeles area, all claiming they had been underpaid, had not received proper meal and rest breaks, and had not been paid for overtime hours worked. The employees hired a Lawfirm to pursue this claim against our client.
The Dispute
This case raised important issues related to the cost of defending an action where the employer had proof of proper payments, rest periods, and overtime. However, the cost associated with defending this action was mounting and the tactics of the lawyers for the employees was bordering on unethical practices.
The Resolution
Given the nature and cost of trial, and the unknown risks, the client decided that it would be more prudent to offer a nominal settlement amount to the remaining few employees to settle the matter and drop the Wage & Hour claim.
