This case involves the importation of goods from China to the United States for resale at known big box retailers. Our client, the plaintiff in this matter, facilitated the acquisition and shipping of goods from factories in China to the warehouse of the defendant. Defendant would then distribute the goods to its customers in the United States.

The Dispute

The two businesses worked together for a number of years with our client providing the financing to bridge the seasonal financial commitment of defendant. After the seasonal merchandise was sold and the defendant was paid by the retailers, our client would then receive its payment. This factoring of receivables by our client to the defendant importer would sometimes reach into the millions of dollars.

The Resolution

After several months of litigation in the Federal Court, we successfully got the matter into mediation with an attempt to settle it there. At the mediation, the defendant continually claimed that it was on the verge of bankruptcy and that our client overcharged them and refused to take part in any meaningful mediation negotiation despite our client making a very reasonable settlement offer. The parties did however agree at the mediation to resolve the dispute under binding arbitration.
